LEGAL AID SOUTH AFRICA

Legal Aid South Africa provides FREE legal services to those who are financially vulnerable and cannot afford a private lawyer. Provided that the person complies with the 'Means Test'.

Legal Aid South Africa is an independent statutory body established by the Legal Aid South Africa Act 39, 2014, as amended.

The aims of Legal Aid SA are to:

  • Give legal aid or to make legal aid available to indigent persons within its financial means.

  • Provide legal representation at State expense, as set out in the Constitution of the Republic of South Africa, 1996 (the Constitution) and relevant legislation giving content to the right to legal representation at State expense.

  • Provide education and information concerning legal rights and obligations.

Legal Aid South Africa’s role is to provide legal aid to those who cannot afford their own legal representation. This includes poor people and vulnerable groups such as women, children and the rural poor.

Currently the required 'Means Test' is as follows;

  • If you are employed, you must earn less than R7,700.00per month after tax has been taken off.

  • If you live with other people for more than 4 nights per week, and these other people share in the cost of food and other costs, then we will look at your total household income. We will only give legal aid to households that earn less than R8,400.00per month.

  • Own a house, then the total value of the house and all your belongings must not be worth more than R665,800.00. You must also only have the one house and you must live in it.

  • Do not own a house, then the total value of all your belongings (for example, your car, furniture, clothes and other personal things) must not be worth more than R141,900.00.

We trust that we have provided you with assistance and hope that you are able to find the best solution for your legal needs.
